Europa Gym Centre CIC– General Terms & Conditions
References to we, our, us, Europa, Europa Centre in these Terms & Conditions are to Europa Gym Centre CIC (registered charity no: 1058489)
These terms and conditions, code of conducts and policies set out the agreement between us, you should read them carefully before enrolment and any purchases.
1. Europa Annual Club Membership
1.1. Annual Club Membership is applicable to students enrolled in our classes.
1.2. Annual Club Membership at Europa is £40.00 and is charged on joining (renewed on the same month of joining annually).
2. British Gymnastics Annual Insurance
2.1. All Members must hold valid British Gymnast Insurance. This can be applied for at https://www.british- gymnastics.org/memberships .
2.2. It’s the responsibility of the Member to obtain insurance. Insurance is renewed annually.
2.3. See British Gymnasts website for up-to-date insurance fees. Europa shall not be held responsible/liable for any increase in insurance fees.
2.4. Participation in classes will not be permitted without valid insurance.
3. Fees & Additional Charges
3.1. Annual membership is non- refundable and is payable after the trial with the monthly fees.
3.2. After the trial you have 24 hours to pay the fees. If we do not hear from you the participant will be removed from the class and the space offered to the next child on the waiting list.
3.3. Participation is not permitted without Club Membership or British Gymnastic Insurance.
3.4. The invoice for Class fees is posted on the 14th of each month and due before 28th of that month payable each month in advance, fees can be paid by using the JoinIn APP (we do not accept American Express), participation is not permitted if the required payment has not been received in advance.
3.5. If no fees have been received in advance the participant will be taken out of the class and the space offered to the next participant on the waiting list.
3.6. Our classes run continuously throughout the year excluding Bank holidays and the Christmas break. Please see www.europagymcentre.com for up-to-date class age groups and times.
3.7. Fees maybe increased on a yearly basis at our sole discretion.
3.8. No refunds or credits will be given during closure which is enforced by the government due to but not limited to global pandemics. Fees already paid can be used for holiday workshops.
3.9. Late payments will have a £10 admin charge added.
4. Return and refund for Europa Centre Shop
4.1. Non-faulty items: We do not offer returns or exchanges for non-faulty items. This includes situations where customers have chosen the incorrect size, to ensure the perfect fit we provide samples sizes at our reception we encourage customers to take advantage of this service before making a purchase.
4.2. Faulty items: In the unlikely event that you receive a faulty item please contact info@europagymcentre.com within 7 days of receiving your order. Provide your order number and details of the fault and our team will guide you through the return process. Upon receiving the returned item, we will inspect it to confirm the fault and if verified we will offer a replacement or issue a refund.
5. Absence and Cancellation
5.1. If the participant attends any classes during a month, then you will be liable for the full month payment regardless of attendance and no refund will be given.
5.2. There are no discounts or refunds for illness as you are paying for the participants space within the class. The full months payment is due regardless of your child’s attendance.
5.3. If the participant does not attend classes for more than three weeks without you notifying us, then their space will be given to the next child on the waiting list.
5.4. If the participant decides not to continue at Europa you must inform us upon receiving the next invoice to avoid being liable for the next month’s full payment.
5.5. Club membership and British Gymnastic Insurance are non- refundable. If you are joining another club the insurance can be transferred. This will be your responsibility.
5.6. We may on occasion have to cancel classes or change venues due to events taking place at Europa. We will always let you know of any changes in advance where possible of you paying the monthly fee and will of course reflect this on your invoice if needed.
5.7. Europa reserves the right to cancel classes, alter the times and/or venues of classes
6. Photos and Footage
6.1. From time to time, we may take photos or footage of our members in the centre and place them on our notice board, website, in newspapers, social media, on television or used for promotional purposes. If you do not wish for the named applicant’s image(s) or footage to be used in any way you must let us know in writing immediately addressing the letter to the “Club Welfare Officer” ensuring that the applicant’s name is visible and legible.
6.2. Unfortunately, if you decide not to allow photos or footage your child will be limited to what events they can take part in.
7. Medical
7.1. If an applicant has any medical details that we need to know it is your responsibility to ensure the medical details section has been completed when registering your child and kept up to date with any changes.
7.2. Any child that requires an inhaler this must be marked with the child’s name. It should be handed to the coach in
charge of the class at the beginning of the lesson and collected again at the end. The staff may assist the child, but the child must administer it themselves or have a parent/carer at the centre to administer the medication.
7.3. All incidents and accidents will be recorded and parent/carer notified at the end of their lesson or before depending on the severity.
8. Holiday Workshops & Activities
8.1. Once payment has been received for holiday workshops, camps and holiday activities no refund or credit will be given for cancellation or non-attendance
8.2. If we receive 72 hours notice for a change of date an alternative may be offered at our discretion and availability.
9. Safety and Registration
9.1. Parents/Carers and other family members are not permitted inside the gymnasium. Please talk to the person running that particular event.
9.2. Please register at reception for all activities and pick up a coloured card this relates to your class and is to be handed in to the coach on the door.
9.3. Please use toilets and changing rooms on the second floor. Toilets on the first floor are solely for the use of
gymnasts/dancers and fitness members. Please ask your child to go to the toilet before their class. The children will be required to go to the toilet on their own.
9.4. You must drop your child to the Gym door ensuring they enter the class via the correct door. Once in the gym the responsibility of the child is then handed over to the Europa Centre staff.
9.5. Parents/Carers must then vacate the first floor. Screens are available to view in our coffee shop on the second floor.
9.6. As this is a busy venue parents/carers are asked to supervise their children and are not left unsupervised at any time.
9.7. While in the gymnasium every effort will be made to ensure the safety of all class members. It is the parents/carers responsibility to ensure their safety and whereabouts when the child is not taking part in their class. Europa Centre is only responsible for your child while they are taking part in their specific class time not before or after.
9.8. Parents do not need to stay for the duration of the class but must ensure they collect their child on time and that any contact details that we hold are current.
9.9. Children are allowed to bring water with them this will be placed in a bottle carrier (so no large bottles please) and held by the coach.
9.10. 5 minutes before the end of class (and not before) parents/carers can wait for their child by the pick-up barrier on the first floor.
9.11. You must collect your child from the parent pick-up area on time. We do not release your child until they recognise their parent/carer. Once the child’s class has ended and the child has been collected by you the responsibility of the child is no longer that of the Europa Centre staff. Children cannot be left in the centre without supervision.
9.12. If you are running late, please let us know so that a member if staff can continue to take responsibility for your child until you arrive. We advise that you put our number in your mobile so you can easily contact us.
9.13. If you choose to drop off or collect your child in any other way than stated above i.e. children arriving and leaving on their own, please let us know in writing addressing your intentions to our Club Welfare Officer and ensuring your child’s name is visible and legible. This will also mean that as soon as the class has ended the responsibility of the child is no longer the Europa Centre staff. If you choose not to adhere to any of the rules on dropping off and collecting your child the Europa Centre will not be held responsible for your child other than during their class times your child is enrolled in.
10. For Safety Purpose
10.1. For Safety purposes: Members should wear comfortable clothing to allow freedom of movement while at the same time clothing must not be too loose fitting for safety reasons. Denim, school uniform, skirts and crop tops are not allowed. Leotards for girls and leotard and shorts for boys are preferred for gymnastic classes please see our website for club leotards and shorts.
10.2. Hair must be neatly tied back with no exceptions, hair beads are not advisable.
10.3. It is forbidden to wear any form of jewellery in the gymnasium. Religious jewellery must be taped or covered with high neck, long sleeves or wrist bands all provided by the member. (tape and wristbands are sold at reception).
10.4. Gymnastic members must be barefoot during training times unless there is a medical reason which should be discussed with the coach in charge of the child’s class at the start of the lesson.
10.5. Children are advised to come already changed in their gymnastic clothing.
11. Personal Property
11.1. The Europa Centre cannot be held responsible for any items lost/stolen or damaged on the premises including the Europa Centre car park.
11.2. Our advice is to clearly label all participants belongings with their name and advise that you do not bring any items of value such as jewellery, watch, mobile phones, tablets etc.
11.3. Lost Property can be found at reception, please note that the previous months lost property will be disposed of or donated to charity.
12. GDPR Privacy Notice Opt-in Consent
12.1. General Data Protection Regulations has placed a legal obligation on businesses that process personal data and has created rights for people whose personal data is processed.
12.2. We take your privacy seriously and ensure your personal information is kept secure. We will only use your personal information for contractual purposes to administer your account or, in the event of an emergency, provide the service you requested from us.
12.3. From time to time, we would like to communicate with you with details of news, events, competitions, special offers, change of terms & conditions and respond to any comment or questions you may send and about any changes to classes.
12.4. Keeping in contact: By opting in you agree to us contacting you by email, SMS and telephone, we will only contact you if you have permitted us to do so.
12.5. You may also opt-out at any time however, we will not be able to contact you from then on.

PRIVACY & SECURITY POLICY
Our Childrens Privacy Policy
At Europa centre we take your privacy seriously.
Please take time to read our children’s privacy notice which explains how we collect and look after your personal information.
As a young person under 16 years of age we rely on the consent of the person who has parental responsibility for you to join Europa. This may be your mum, dad or someone else who gives their permission for you to take part in our gymnastic sessions.
We ask the person with parental responsibility for you to provide us with your name, address, a telephone or mobile number, your age, an email address and the details of someone that we could contact in an emergency or if you have any medical conditions we need to know about. This information will enable us to provide you with the service you have asked for. We hold this information to help us fulfil our legal obligations. Your information will not be shared with anyone.
We only keep your information for as long as we provide you with a service subject to certain legal obligations. After this your information will be deleted. You may request to see any information we hold on you.
The information will be stored on Gymnastics Biz. You can read how Gymnastics Biz store your information when you complete the registration form online.
Europa centre will look at your account from time to time to make changes that you have told us about or update your account.

EUROPA SAFEGUARDING POLICY
Europa gymnastics centre acknowledges the duty of care and promote the welfare of children and is committed to ensuring safeguarding practice and British Gymnastics requirements.
The policy recognises that the welfare and interests of children are paramount in all circumstances. It aims to ensure that regardless of age, ability or disability, gender reassignment, race, religion or belief, sex or sexual orientation, socio-economic background, all children:

Have positive and enjoyable experience of sport at Europa Centre in a safe and child centred environment.

Are protected from abuse whilst participating in gymnastics at Europa Centre or outside of the activity.

Europa Centre acknowledges that some children, including disabled children and young people or those from ethnic minority communities, can be particularly vulnerable to abuse and we accept the responsibility to take reasonable and appropriate steps to ensure their welfare. All staff are to familiarise yourself with the staff handbook chapter 9 safeguarding policy.

As part of our safeguarding policy Europa Centre will:

Ensure everyone understands their roles and responsibilities in respect of safeguarding and is provided with appropriate learning opportunities to recognise, identify and respond to signs of abuse, neglect and other safeguarding concerns relating to children and young people.

Ensure appropriate action is taken in the event of incidents/ concerns of abuse and support provided to the individual/s who raise or disclose the concern.

Ensure that confidential, detailed and accurate records of all safeguarding concerns are maintained and securely stored.

The policy and procedures will be widely promoted and are mandatory for everyone involved in the Europa Centre. Failure to comply with the policy and procedures will be addressed without delay and may ultimately result in dismissal/ exclusion from the organisation.
METHODS OF PAYMENT
REFUND / RETURN POLICY
Methods of Payment to EUROPA GYM CENTRE CIC (Registered No: 07449041)
Upon joining Europa you will be sent a link to set up a GoCardless account for monthly payments.
Fees can also be paid by Cash or Credit/Debit Card (Visa & Mastercard)
We DO NOT accept American Express.
We can also take Credit/Debit Card Payments over the phone. We do not post credit card receipts, your receipt will be shredded and disposed of accordingly.
Payments via Credit/Debit Card (Visa & Mastercard Only) can also be made via our Customer Portal.
By processing your payment through our system you agree to accept all our Terms and Conditions, available to view on this website & available to view on the Customer Portal. An accurate description and pricing for all goods and services, in GB£ will be available to view through this Customer Portal.
Return / Refund Policy
Class fees are payable in advance on a Monthly basis. The number of classes available per Month can be different. This results in a difference in cost per Month. We will send you a statement via email before the fees are due outlining the cost per Month, these are also available at reception. Fees must be paid between the 21st and the 28th of the month during the month prior to which you are paying for. Ie. You must pay by the 28th September for October. If your child attends any classes during a course then you are liable for the full course regardless of attendance and no refunds will be given.
There are no discounts or refunds for illness as you are paying for your child's space within the class. The full course payment is due regardless of your child's attendance. If your child does not attend any classes for more than 3 weeks without you notifying us then their space will be given to the next child on the waiting list. If there is a situation where the child has a long term illness or injury then you will need to discuss the matter with Reception and not assume that you will not be charged if your child is not attending.

Gym Zone tickets are non refundable, however you can transfer your tickets to another date up to 24 hours before your booking.

COMPLAINTS POLICY
As a club affiliated to British Gymnastics, Europa is bound by British Gymnastics procedures for complaints, disciplinary issues and membership suspensions and expulsions.
The club places the welfare/safeguarding of its members as the highest priority. Our club operates an open-door policy where any gymnast, parent/guardian, coach or club official who has a complaint or grievance against any other user of the club is encouraged to raise these in a timely manner to enable the problem to be discussed and resolved as quickly as possible.

The following procedure will be followed:

Stage 1
VERBALLY TO THE COACH/CLUB OFFICIAL
The concern or complaint should initially be raised with the relevant coach or club official. A face-to-face meeting should be requested as soon after the incident as possible. A club welfare officer will also be present. Both parties should try to remain positive, open, civil and respectful with the aim of resolving the situation at this initial stage.
Stage 2
IN WRITING TO THE DISCIPLINE LEAD COACH OR CLUB BUSINESS MANAGER
If it is a more serious concern/complaint that cannot be resolved verbally with the coach of club official a written complaint should be submitted to the Discipline Lead Coach (for all coaching matters) or Club Business Manager (for any non-coaching matters) within 15 working days detailing the grievance.
If the complaint is against the Discipline Lead Coach, or the grievance relates to the welfare of children, the parent/guardian should contact the Club Welfare Officer. The Lead Coach/Business Manager or Club Welfare Officer will arrange a meeting with the relevant parties within 10 working days to discuss the grievance and agree the course of action to address it.
The Lead Coach/Business Manager or Club Welfare Officer will write to the complainant within 10 working days of the meeting detailing the course of action to be taken and the reason for them.
Stage 3
WRITTEN APPEAL TO THE BOARD OF TRUSTEES
If the complainant is dissatisfied with the outcome, they can appeal in writing to the Board of Trustees stating why they are dissatisfied and consider the decision inappropriate.
The Board of Trustees will hear the submission of both parties and any decision made in stage two will then be reviewed and the outcome must be determined within twenty-eight days of the statement being exchanged. British Gymnastics complaints procedures will be implemented if an issue cannot be suitably addressed at club level. This can be found through www.british-gymnastics.org site.
